our company overpaid commissions over a period of months before they caught the error. now they.ve decided to take the money back (about $1500). we never see the figures comms are based on so this is news to us. Is this legal.

Yes, it is legal but you are entitled to a breakdown or report of your commission statement by law.

If they refuse to give it to you, report them to your states wage & labor bureau. All employees are entitled to a breakdown of wages.

yes they can. If they overpaid you they can take it back. Same thing if they underpaid you, you would expect them to give you the correct amount. Plus if you knew they overpaid you, and didn't return it, thats not only dishonest but stealing.

I would check with a coporate lawyer, but its been my understanding that once its paid, its paid and there is no taking it back. By the same standard though, if you were shorted on your check, you would definately want your money that was owed. Same principle.
