In NY they recognize the step parent being financially responsible for the step child.does anyone know if CA courts recognize that child when determining child support for previous biological children? The step child does not recieve child support from biological father.

the reason I am asking is my husband is paying for 2 children from a previous marriage the mother doesnt work so he is paying 1200 a month we just had a baby and I have an 8 year old from before. His father is incarcerated for 6 years so I dont get child support I tried to get state assistance for my son and they denied saying my husband is responsible but the judge in my husbands custody hearing didnt take my son into consideration. Its not that I am forcing my husband to pay for him its just that because I just had a baby (which btw the judge didnt take her into consideration either) I am not working so our income is lower. We live in NY and the ex lives in CA

To NoSunHere-First of all I had been taking care of my son for 8 years by myself without state assitance. I worked in CA since I was 18 as a pharmacy technician making 17 dollars an hour. The Army moved us to a part of NY were there are no jobs that are above minimum wage. not only that but I was working when I got pregnant. I'm not an irresponsible mother I can take care of my kids just fine. Its mothers that refuse to work and expect the ex husbands to pay out of thier *** for kids they dont even get to see that you should be saying to take care of thier own kids. You know nothing about me so unless you can answer the question with knowledge instead of a louzy opinion keep your comments to yourself

Each state is different--but it doesn't mention step-parent income:

First - STOP HAVING BABIES!

Everything else set aside - the non-custodial parent is responsible for child support of his/her children. Period. You do not get "credit" for having step-children. You do, however, get "credit" for remarrying and/or [god forbid] having [yet] another child.

Your new husband is responsible for his children. Your old husband is responsible for his children. The state is NOT responsible for anybody's children, although it will help out with welfare.

Okay now - everybody take care of their own children. Including you!

this link might answer your question but i feel it is unfair to make a stepparent pay for a child he did not father unless he adopted that child
