I bellieve it depends on the nature of the crime. If it is a Federal Crime, its tried in Federal Court. If its a state crime, then its tried in State court. Most Federal Crimes usually involve FBI involvement or higher agency, because the crime involves more than just the state.

When the amount in question is over a certain $ amount (I think its $100,000), or when it involves Federal jurisdiction such as interstate commerce.
