What should I do?
I let a friend put a vehicle in my name. Tags and insurance are in my name. On Friday, he was arrested on drug charges. What could happen to me concerning this vehicle? Could I be arrested as an accessory? He was not arrested in the vehicle, but I'm not sure where it is now. He travels alot between TX and NC. We are in NC.

The reason I did it was because he is going through a messy divorce, and his ex told me she was going after everything she could, so that he would have nothing. I was just trying to help him out. I didn't think I would get in trouble. Where I live, half the people on welfare have really nice cars beause the car is in someone else's name.

Also, the car is not mine. He just put it in my name to protect it from his ex (or so I thought). I know it was a stupid thing to do, and I have learned my leason. No one needs to tell me that. I just need some helpful advice.

Im a lawyer in NY, and TELLING you to get a lawyer.
If he was using the car to transport drugs, you could be in a heap of trouble. Of course, you didnt know he was doing it, you didnt see it, sell it, use it, etc. And you werent with him, when arrested.
But i'd get a criminal lawyer on the double. And if you put money aside for a rainy day? It's raining. Use the money.

ANSWER TO PS: Im not a criminal lawyer, but thats why my 1st gut instinct is to tell you to get one in a hurry.... If you go and tell them, theyre going to make you sign a confession or a sworn statement of some type which can be used against you in court. The LAST thing you want to do is voluntarily go to them and do that without proper legal advice or counsel at your side. Dont delay, hon. Get a criminal lawyer quick. I dont know what state youre in, but in NY, usually consultations are free, so at least make a couple of phone calls from lawyers in your local yellow pages and get a number of opinions as to what to do.
Seriously, good luck. Dont panic. You didnt do anything wrong. Just get advice before doing anything rash.

PSS: When was your friend arrested? If he was arrested 4 or 5 days ago, and they wanted to prosecute you, you wouldve been picked up by now. You may get a call from a detective and he may question you about it, but ALWAYS be honest. "He got arrested for WHAT??" etc etc.
Chin up, crazy. Youll be fine, the more i think about it. Just get a lawyers advice (for the umpteenth time!)

If you do get arrested hire an attorney BEFORE you talk to the police. They will advise you of your rights, do not try to talk your way out of it. Probably all that will happen is the car will be seized. This is serious business, treat it as such and shut your mouth. A lot of people talk themselves right into trouble simply by believing that the truth will set them free. A police officers job is to gather evidence, believe that and get an attorney. If they show up on your doorstep, get an attorney. If they ask you to come to the station, get an attorney. Political careers are made by the "war on drugs", the hottest crime in the nation, do not fall prey. Peace and Good Luck.

I work as a a car dealer in Ontario, Canada.

I f the vehicle, the tags, and the registration are in your name than for all intents and purposes you own 100% of that vehicle.

so you have two options:
1) do nothing...say you lent him the car and thats it.
2) report the car as stolen or missing....it may not help your friend out but it covers your butt.

I would do absoloutely nothing...I would however find out where that car is...if the vehicle is involoved in illegal activity and you have not reported it stolen...you may then be considered an accessory.

so my advice is find the car, get a set of keys cut...drive it home and leave it there.

if no way of finding the car..then call it in as missing...be straight with the cops and tell them the truth you should be cool as long as you werent actually involved.

The car is in your name, but not yours. You should be alright. The tags and insurance are in your name. Now that you've learned a lesson. You are very lucky. He was not arrested in the vehicle. (If he gets pulled over while driving that car, you're part liable) You need to get ahold of him and let him know he needs to get the insurance, tags, and car out of your name. If he's a friend, he'll understand. I THINK you should be alright, but in order to protect yourself, call your local legal aide and explain the situation to them. they'll be able to assist you further

If he didn't get caught in your car then what is your concern on that end? Since the car is in your name, that means that the car is yours. Hopefully since he was hustling, the car is paid off. If it is, then that is a good come upfor you. What you need to do is find out where the caris and get it. I don't know if you are just a sideline chick to this man, you may have problems with the girlfrind and even some family. You need to make contact with him and get info on this car. You don't want anyone drivin your s*** and they wreck it or anything. Is dude getting out on bond?

well it sounds like you have an insured vehicle to drive while he is locked up. Go, girl get your ride on now!!! Find before someone else writ on him. And when he gets out if you wanna give him back his car, do so!! But don't provide him the option to have you sued by his irresponsibility

The car is in your name. It's your property. It can't be seized from you, but you will owe the money on the note. It won't be a total loss.

Get the car from him to further protect it.

yes you could be in legal troubble. talk to a lawyer. my brother in law bought a car for his girlfriend --he had everything under his name even though it was her car(because of alimony reasons) . she got pulled over for running a stop sign. she got a dui, and my brother in law had his car insurance cancelled and he was put on probation for 6 months for letting some one under the influence drive his car, and a couple of other things. it couldn't hurt to just call and talk to someone.

You are lucky, if he had an accident yuou may have been resposible. Go speak with him and have hom sign the car over to you to sell, or turn it into thepolice and calcel the incurance.
