Do exactly as everyone is stating... if she filed for child support, you should be right there in the court room demanding for joint custody and open visitation.

But that's also depending upon your dedication as a father. If you're sincere in your motivation to spend as much time with and support your child, you'd move heaven and earth!

File for custody, pay child support, and get visitation rights. Even if she files, go to court and ask for joint custody. Just because she asks for sole custody doesn't mean she will get it. Fight for your rights at all costs. If you can't afford it, seek legal aid.

Anytime you give her any money, make sure you have proof in writing that says what it's for.

OK OK there are allot of bad ideas here so here is the truth visitation or possession as it is now called is your right weather or not you pay child support they are not mutually exclusive. However for you to build a case I recommend you pay whatever you owe as it is a crime to not do so as is it a crime to deny possession or visitation once you are caught up file for enforcement of visitation have good documentation a calender or a diary that shows all the times you tried to see them but were denied a good judge will give you the visitation if she does not comply file a motion for contempt she might go to jail enough screw-ups you can modify get the kids your self

If you werent paying child support she had all legal rights to not let you see your child if no visitation has been established through the courts... Doesnt make it fair or right!!!!

If however you do pay child support, then you can fight her for visitation rights.... If you pay child support, you have rights to visitation... Whether you excercise those rights or not is up to you...

Even if she does get sole custody, you can still have visitation with your child.... (if you are paying your child support as ordered)

At least that is how it works in upstate NY, where my daughter's father lives....
