Because dumpsters are usually located on private premises, dumpster diving is illegal in some parts of the United States, though the law is enforced with varying degrees of rigor. The California v. Greenwood U.S. Supreme Court case held that there is no common law expectation of privacy for discarded materials. Dumpster diving per se is probably legal when not specifically prohibited by state or local law.
Police (and possibly other) searches of dumpsters and like discards are not violations; evidence seized in this way has been permitted in many criminal trials. The doctrine is less well established in regard to civil litigation. Similarly in the United Kingdom, while dumpster diving in England and Wales may qualify as theft within the Theft Act 1968, or as common-law theft in Scotland, there is very little enforcement in practice.

some place consider dumpster diving illegal. but then they are throwing it away. hell if a person can get new goods free go for it. it is not actually stealing, they threw it away.
there is this place in town here, its like a thrift store or good will store. people drop stuff off in back if the store is closed. well people go back there at night and dig through the stuff for anything good, even I have done it. it is kinda fun. well now they put up a camera. that catches the persons care and license plate.
then you are charged with theft and get a three hundred dollar fine. i now longer go back there, that i know of people who were caught on tape and charged. funny thing is, they get the stuff free, and it is not in the store, so how can it be stealing.
and they get this stuff free and charge prices that are way to high.
hell go for, go for the dumpster dive if you can.....

Truthfully there is no way to answer this as laws in different areas,even city by city are sometimes different. In some jurisdictions as soon as something is thrown in a trash recepticle of any kind it's considered community property,but I have also heard of cases where it's considered the property of the disposer as long as it's on their property.Sometimes for reasons of liability,such as if they threw it away and you took it and were harmed by it could you then sue them,sounds silly but after coffee burns at McDonalds being worth hundreds of thousands companies are taking no chances. Only way to be sure is to check local law which shouldn't be too hard on internet.

Each municipality has differing laws on this. However, generally speaking, I would say no, it's not illegal, as long as what's in the dumpster is really intended to be thrown away. I did some of my best dumpster diving in college.

Yes it is illegal. According to a police friend, you can be issued a ticket and fined if the property manager wishes to pursue.

It constitutes trespass. Many business' now lock up their dumpsters to keep people out. Because people hurt themselves and then sue.

not at all. but they usually destroy it b4 putting in the dumpster. . & plus its obviously broken or not working. . what ever it may be. . so, why would you want it ?
