my theory is that the drugs that were prescribed weren't in his name.. so the charges that might be filed will be against the responsible owner of the drugs.

prescribed to somebody.. illegal if taken by another.

Hard to say though.. could be negligent charges.. too..

An autopsy was performed Monday. On Tuesday, Her Majesty's Coroner Linda P. Virgill said that based on preliminary findings, "the cause of death is not natural." But, she said, "we wish to reserve [announcing] the cause of death at this time," adding that a toxicology results and a full autopsy report will be released by the end of the week.

Virgill said an inquest will take place afterward and her staff will interview all "relevant witnesses," including Anna Nicole Smith, hospital workers and flight attendants, to develop an official timeline.

The coroner's statements came in the wake of a story in the Nassau Guardian that Daniel Smith suffered a "massive heart attack" and that antidepressants had been found in his system. The newspaper said that Daniel was seen "vomiting uncontrollably" shortly before his death.

I asked this same question and the majority of my answers says over dose on his anti-depressants. I think the same drugs def played a role in this the rest is just media hype, the third person in the room was probably just Anna Nicole Smith's daughter's father and because she has not released his name for whatever reasons she has the press won't release it either...

The toxicology report will tell. I am embarrassed to say that I actually watched the Anna Nicole Show because it was like watching a train wreck every week. I still remember feeling sorry for her son because of the things he witnessed his mother doing (posing nude, laying around the house nude, fondling women's breasts, throwing insane tantrums, abusing people emotionally). She even bragged that when he first started school he took her nude photos to school. She always tried to say that he was happy and fine with her lifestyle but the antidepressants say something different, don't they.

"Anna Nicole is absolutely devastated by the loss of her son. He was her pride and joy and an amazing human being," a statement on the site said. It said that drugs or alcohol were not believed to be a factor.

Coroner's office: Death of Anna Nicole Smith's son 'suspicious'

NASSAU, Bahamas (AP) -- The chief inspector of the Bahamas coroner's office on Wednesday called the death of Anna Nicole Smith's son Daniel "suspicious" and said a formal inquiry that could lead to criminal charges was being scheduled.

"Whenever there is a suspicious death, we would have an inquest to determine how the person died," Bradley Neely, chief inspector of the coroner's office, told AP Television News.

Her Majesty's Coroner Linda P. Virgill scheduled an inquest for the week of October 23, saying it "is the right course of action." If jurors at the inquest decide a crime took place, the case will be sent to the attorney general's office, authorities said.

Earlier, Virgill told The Associated Press that authorities believe they know what killed Daniel Wayne Smith, but are awaiting a toxicology report to confirm the findings.

"We do know the cause of death," Virgill said. "But we need to confirm it with a toxicology report."

She declined to disclose details but said there was no sign of physical injury to Smith, who died while visiting his mother, a reality TV star and former Playboy playmate, in a hospital three days after she gave birth to a baby girl. (Watch doctor describe Smith's reaction to son's death -- 4:11)

Deepening the mystery, Virgill said there was at least one other person in the room when Smith died. She refused to elaborate.

"I can confirm that there was definitely a third person in the room at the time of death and I do know who that person is," she said. "But I am unwilling to reveal that information at this time for various reasons."

A formal inquiry may be launched, in which case officials will not publicly disclose their findings until after it is completed, Virgill said in an interview.

Meanwhile, police were reconstructing Smith's steps since his arrival Saturday in the Bahamas, said Reginald Ferguson, the assistant commissioner of the Royal Bahamian Police Force.

Ferguson told the AP that no drug paraphernalia or traces of illegal drugs were found on Daniel Smith, in the hospital room or near the room.

"We haven't found any illegal drugs or anything of that nature in the course of this investigation," he said.

Police believe Smith went directly to Doctors Hospital in Nassau, where his mother was, after flying in to the Bahamas, Ferguson said.

Daniel Smith was the son of Anna Nicole and Bill Smith, who married in 1985 and divorced two years later. The son had small roles in her movies "Skyscraper" and "To the Limit." He also appeared several times on the E! reality series "The Anna Nicole Show."

Anna Nicole Smith married Texas oil tycoon J. Howard Marshall II in 1994, when she was 26 and he was 89. He died the following year.

She then feuded with Marshall's son, Pierce Marshall, over her entitlement to the tycoon's estate before he died in June at age 67.

Smith won a $474 million judgment, which was cut to about $89 million, and eventually reduced to zero. In May, the U.S. Supreme Court ruled that Smith could continue to pursue her claim in federal courts in California, despite a Texas state court ruling that Marshall's youngest son was the sole heir.

The plot thickens. I read the same article. I wonder if it's possible he was poisoned or poisoned himself. We'll just have to wait and see.

There really isn't any way to know until more details are released. He was so young and that is a sad tragedy.
