I am not saying he is. But am I allowed to think it, and say that I think it?

You are entitled to your own thoughts and beliefs and you are entitled to freedom of expression... however, if you go on TV or radio and you say that HE IS, without proof, you can find yourself in a heap of trouble (lawsuits) but if you say, "I think he's gay" the fact that you said, "I think" is far different from saying that he "is."

Saying that you "think" he "is" would constitute your belief and your opinion and that is what you are entitled to express but not something that is yet factual (since he has not admitted to being, or that you can PROVE he is).

Slander would be if you said "Tom Cruise is gay" or "I have it on good authority that Tom Cruise is gay," or some other statement that you cannot prove or you know to be false or is not yet proven.

Liberace sued and won a lawsuit for being called gay... but HE WAS GAY and he died of AIDS... but it was never proven so he won his lawsuit.

Saying what you "THINK" is not stating a fact, and it is NOT slanderous unless you are recgonized as an authority figure (a judge, a TV personality, a news reporter, etc)... then, you better watch what you say VERY carefully!

No he can't! Freedom of thought it is called (freedom of expression is another issue). Thoguhts, and dreams, and beliefs are not liable!
Though in some religions even thoughts are condemned! So good we live in a secular society! And believe me God would forgive you such thought, as it is not strange to Him too :))))

You can think what ever you want and no one can do anything about it, in fact I bet that if you were to say it to your friends it wouldn't even get back to him, but I'd be careful cause Katie may take you out.

I think that this is the safe way to approach it:

I can say that I think that Sean H thinks that Tom Cruise is probably gay, but I think that he is not.................. (that way Sean, we are both safe)...........
