The general informal rule is "The one who files first, wins." I don't exactly know why, because there is no written legal advantage, in any state. There may be a psychological aspect that suggest that the Petitioner is more resolved and pragmatic, and the Respondent is more vindictive and irrational. That's my best guess. I would race to be the Petitioner if I were you; it's better for your own healing.

No...and even less so with child support. Michigan is one of the worst states for collecting it!!!

Yes there are actually. Most often, you are the one who gets to stay in the house while the divorce is pending, and if there are children involved, they also get to stay there with you until placement is officially decided.
