I heard after his term is over, that he could and probably will be spending a lot of time in the defendant side of the courtroom.

Yes but it is limited to things outside the scope of the office.

The President asks congress for a declaration of war and a soldier dies. Family cannot sue for wrongful death.

The President blows through a stop sign and kills someone, suing is an option.

Overly simplified but I think you can see what I am trying to say. There are other place where people are essentially immune from law suits. The good Samaritan law in most states is an example. If you stop to help an accident victim, operate within the scope of your training, make a mistake and the person dies you are normally immune. If you find an unconscious person, sit on their chest until they quit breathing you will probably be help civilly and criminally liable. This sort of stuff hinges on what's "legal", not necessarily what's "right or wrong"

Why would you want him to be sued he didnt do anything wrong. i support bush 110% on all the decisions he made, he was a good president and now some idiot is going to get in the office and screw everything up. i back bush up in the war also cuz i know 3 good friends of mine that our over there, fighting for our freedom. we didnt just get this country by sitting around we fought for it and that is what bush is doing.. i mean come on if you were president when 9-11 happened you would wanna kill the bastards that killed all of those people. 9-11 was an attack and that is what started this whole war it is their fault that we are over there now with our troops!!!!!!!!

No president of U.S., can not be sued.

It is an Office.

It is a post.

How can one sue an Office / Post.

How ever if you want to sue Mr. George W Bush, presently or after his impeachment, you can do so. Anybody can do so.

I'm not sure, but I'd bet anything that presidents, current and ex, are covered by all sorts of immunity clauses. I mean, they provide that to all county DAs to protect them from lawsuits involving criminals they've prosecuted, so it's not too hard to imagine that "courtesy" being extended to all the higher levels of government.

you can sue the government, not sure about the president himself though, i think he will be trying to defend his actions regarding the war and all the soliders that have died because of it.
Not just US, or it shouldn't be anyway but UK Troops aswell.
