No, statutory rape is simply rape by statute, or rape by law. A minor can not legally give consent. Sex without consent is rape. Since no legal consent can be given, it is rape. The law varies by state, another law that should have national standards, as the age of consent varies.

No. If the victim is under the physical age, then it's statuatory. However, if the victim is mentally handicapped, then they are by law unable to consent. So that becomes rape in whatever degree they choose to prosecute in, but it's not statuatory. Statuatory is just physical age.
