Iam having trouble cashing checks issued to my given name "Mary", on birth certificate name is "Maria" and bank will not let me open account or cash checks issued under Mary. Since 9/11 banks have been very strict I understand this but there must be something I can do to show proof legally that "Maria", "Mary" is one in the same as I am without having to change my birth name. Everyone else know's me only by" Mary "unless I go to a different country and if I introduce myself as "Mary" they would call me "Maria". Go figure. SO What Can I do? (And no I am not Spanish but I'm wondering if I was would I still have this dilemma? ) This is not an alias or AKA, I've never used those phrases with my name. ANd the bank is telling me they won't accept 'alias'. Any suggestions would be appreciated. Thank you..

Get an affidavit from a notary public. Use it as the need arises.

Do you have any other documents that have both names and also bear the same Social Security numbers? High School transcripts, college ID and/or transcripts, Driver's License, utility bills, lease, etc.; that's a start. Or, you may just have to ask your employer to change the name on the cheques to your given name. Or, you may ask your employer to issue you a notarized letter on the company stationery (call it an affidavit if you wish, it's technically the same) stating that although your given name is Maria, you are also known as "Mary" and that they have known you for "x" time and that your Social Security number is "xxx-xx-xxxx." Take the letter to one of the Vice Presidents or Managers of the bank and have that person read the letter AND call your employer and let them straighten it out. While Maria is a formal name in Hispanic and non-Hispanic countries, in some Hispanic countries "Mary" is used as a nickname... go figure! You'd have a bigger problem if you were Hispanic (trying to prove that you're not an illegal immigrant).

What name is on your Social Security Card?
So do you use the name Mary or Maria? I am a little confused. Similar incident, my dad's birth name is Joe BUT...the dr. that delivered him was drunk and recorded his birth name as Joel. BUT....he has never had trouble with any accounts. I certainly understand the banking issues post 9/11 as I have no banking account and cannot cash a money order without knowing someone who has an account and cashing the MO through them.

If your given name of Mary, is on your birth certificate, it is a legal name, and can be used by you. If you need a Birth Certificate, you can order one online. I'm pretty sure it cost $23.00, and that includes the shipping. The site will ask you some questions, that only you know the answers to. You pay by charge card, and they mail it to you. Keep a "Copy" of this with you at all times, for cashing your checks.
-OR-
Go to DMV, and add "Mary" next to Marie, or "Mary" instead of Marie.

Make an affidavit that Mary and Maria are the same person and have it notarized by a lawyer. Always bring this with you and the birth certificate for evidenciary purposes in all your transactions.

ask those that issued the checks to re-issue them with your b.c. name.. otherwise you might need a witness or two to state that you and the person listed on the b.c are one and the same.. which is more complicated I assume
