if a major (18) years old say X with a learner's driving lisence without putting a L sign and driving alone gets hits by a car who has a permanent driving lisence say Y and Y says it was X's mistake then what can X do to protect himself? What are the punishments 4 the X. According to Indian Laws...

My dear, there are two types of cases in India regarding motor vehicle accidents. One is under the provisions of Motor Vehicle Act for grant of compensation. If your vehicle is insured, then the compensation will be paid by the Insurance Company otherwise the driver and owner of the vehicle has to pay the claim.

Other case is for rash and negligent driving which is governed by the provisions of the Indian Penal Code. The maximum punishment is for one year, if the guilty is proved. But it is compoundable offence and the matter could be compromised.

1. he can give a little money to the policeman and walk away
2. he can accept his mistake and pay the police and the repairs of the opposite party
3. he can go to court and be proved that he didnt take enough preceutions, then pay the fine of around 1000 rupees and charges for the other mans repairs.
4. he can get insurance to do the job and pay extra premium for the rest of the life of the vehicle.
5. he can get an out of court settlement in the lawyers office or the police station.

But I basically think you should take more precautions taking into account there are innocent general public around you who are at potential danger from your antics.

I am not an inhabitant of India, but in the U.S., you would get a ticket for driving with a learner's permit without a guardian with you. However, it should be noted that, if the person hit you, in the "rear of your car", he also would get a ticket, for careless driving.
