The simplest line from Shakespare that is often ovrlooked is: We do not Judge men Sir, We judge crimes! But then again who decides what is a crime and what is it's worth!
People who are attached to a situation react out of ego and self and thus are the least likely to render what is truely just. Hence the added statement is; people often scream for justice but when they get it they cry for mercy.
Thus collectively the most important thing to do is to concern yourself only with the want of wisdom and compassion and consider them as one and the same!

The single most important consideration is the golden thread that runs through British law.. that is the presumption of innocence until proven guilty. Better that a hundred guilty go free than one innocent be convicted.

I would say circumstance.
It is not right to judge a person who steals a candy bar for kicks the same way that you would judge a person who steals a loaf of bread because he has starving children.
