no change orders were made, the drawings were never revised,the engineer was aware of changes but didn't inform the board members, engineers inspected job and passed it knowing it was not what the contract documents contained. I feel this was done hoping it would never be discovered, I have since uncovered the job and found it to be completly unsatisfactory.

You answered your own Q, the engineer(s).
If there is a board governing this project they should be picking up the ball on legal stuff. If their not or someones balken it. It could be someone got a hand in the proverbial cookie jar.

The contract should spell that out. If there is a quality assurance process, the contract defines how that process is to be implemented. If it wasn't implemented according to the letter of the contract, the quality assurance people are at fault. They would have detected the activities of the engineer who tried to cover up changes.

The person or party who breaches the contract is responsible.

Whoever was responsible for doing the work according to the contract would be responsible if the contract specs were not followed.
