Okay. I want to know how old children have to be in order to tell the judge they do not want to see their real dad. Will the judge be able to speak to them privately? Do I need to hire a guardian ad litem? Their real dad and girlfriend were talking about me to the children and thye had an argument this evening. He said that the children could not have their name changed and because he pays child support he was not giving up his parental rights. I know I cannot force him to give up his rights, but I would love to free myself from the finances. He has a criminal record and he just got out of prison. He had papers served on me saying that I denied him visitation when in fact I was hospitalized this summer. Are there any lawyers out there? I am tired of going to court with him. We have been so many times since our divorce and I am tired. Help.

Good luck! his 7th grade year finally went and talked to the judge and told him some of the BS that goes on with his step mom and his real dad, and the judge granted him the right to stay with the mom exclusively, while still getting child support from the dad. I hope this gives you hope, but I don't know how old your kids are. Good luck, and I hope you find a good lawyer :)

Maybe if a child psychologist could talk to your child then you would have a doctors letter saying the visits are not good for your child, a judge might listen to that. Can you prove how the mother cancels if money is involved that too would help. I know it should be about what is best for the child but in truth sometimes it just doesn't seem to work like that and it is the non custodial parent who seems to have all the rights. I wish I had a better solution but I do think a child psych report on the visits would be a great help in persuading a judge to see your point of view.

12 is the age that the child can say if they want to see the parent any more, and yes the judge will talk to the child and see what they want. I am not sure if you will need a lawyer, but it might not hurt... Good Luck, and hope things workout for the best..

I guess when they're already on the legal age, then they can be able to decide.This is new to me and I dont think there's a way that you can let a child to choose if they're underaged.

Unless, if the parent, a mom or a dad will be a threat to a child. I guess the court will agree on your side to let the child choose wether to see or not to see his/her dad.

Other than that... I had no more idea. Just Pray. IT WORKS anyways!

It varies State by State in Kansas it is 12 yrs old and yes you need to find an attorney !

Depends on where you live but usually at the age of 12 they can make their own decision

has he endangered your kids ???? if he has all you have to do is move and report his endangerment ....otherwise you can find help with the child advocacy center ....he sounds like a jerk !!! i just removed my kids father from there picture and at no cost to me financially but he wasn't paying and had indeed endangered his kids ....according to law , your child has a voice at age 10 and sometimes younger depending on his/her understanding and fear
