Who will legally inherit, the children or the husband? This question refers to the law in the Republic of Ireland

Most probably both will inherit, but you must consult with an experienced real estate lawyer practicing in Ireland. My thoughts are:

If the husband is not a part in the deed of purchase or conveyance, then the house was probably acquired before the couple was married, or the funds for the acquisition belonged to the now deceased woman in a private manner (they belonged to her exclusively).

Since the property belonged privately to the now deceased woman, then her children will inherit most of the property subject to a widowers share, as it this defined by law.

On the other hand, if the property was acquired by the couple (jointly) then the children will inherit 50% of the property subject to the same widower's share. The widower is the owner of the remaining 50%.

Not sure about the ROI but in the UK, the husband would inherit.
In scotland, the children would be able to apply for 50% of the inheritance, but again, im not sure if this would be the case in Ireland.

Normally everything goes to the partner as long as they were married, unless the children contest it.

it will go through a probate lawyer, in instance with no will.....
