I have been divorced since 1993 but now that our daughter is older we need to change our custody and child support guidelines. I need to know the legal term for this so i can research and see if i can file without an attorney. Any help you can give is appreciated

It is called an Agreed Motion to Reallocate Parental Rights and Responsibilities. (If you are both in agreement) It can be done without an attorney but there are lots of additional forms you need to make sure you have when you file the paperwork.

It is the modification of child support and child custody. I don't know what state you live in but I know in the state I live if child support is paid through the child support office you can call them and you can request mediation, they will allow you four free hours of mediation and will file the amended papers with the court at no expense to you, if it goes over four hours it is $75 an hour. Most attorneys around here charge $325 for a modification IF both of the parents are in agreement. Check with your local child support office first and see what they can do for you and if they can't help take an attorney up on their free consultation.

I believe you have to file a Divorced Modification and a date for a hearing will be set at that time. The opposing party will be served with the modification and court date. At the hearing, the judge will rule and issue an order granting the changes requested unless the opposing side objects.

If you go to the law library, someone there could probable lead you to the formal language. That will take a lot of time. To make it easy, personally I would look in the phone book under Paralegal. There are firms who do this type of work for you at a nominal cost.

When it has anything to do with a child's custody and child support don't do it your self it could led to big problems and I do not wish problems on anybody so please go see a lawyer or call a lawyer hot-line!Good Luck with your situation!
