By entering the restaurant and ordering something to eat, you have entered into an agreement to pay for the service (cooking and serving your meal) and the end product. To leave without paying, you have broken that trust and have, in effect, stolen something that you (by your earlier actions) had agreed to pay for. This is a form of theft or larceny.

I'm no lawyer, but I do believe they can charge you with theft of services. I think each state has its' penalties, in some, depending on how much was owed, could be as little as a class B misdemeanor, which is a little worst than a driving ticket.

Larceny or theft. Depending upon the state you are in, it will be a misdemeanor or felony based upon the value of the tab.

theft of services. they can sue you and make you pay up to 5 times the bill and charge you criminally.

If the meal was more than $300 - felony and bigtime jail time and restitution for the bill.
