You're right to think that women who impose drugs on their unborn children should be punished..
It should go beyond taking the children from them at birth, forcing them into rehab, and using tax dollars to do this..meanwhile cps is doing their best to get the family back together..because it is afterall..their job.
she should be inprisoned, her parental rights should be severed without question. she should be sterilized..
its harsh..
until you've seen a newborn baby writhing from the pain of withdrawal..when you see a kid struggle to breath and live because of his mothers selfish stupidity..

Unfortunatly a fetus is not considered a human life, until later in the pregnancy, I believe 36 weeks therefore they cannot prosecute until after that time. Usually these babies are born Addicted as you say they suffer from, withdrawl symptoms and later learning disabilities. Law makers are trying to change when a fetus is considered a Baby, this also goes along with abortions though, Many babies that look very much like babies are aborted, millions since abortion was legalized. Persecuted or prosecuted? It's hard to put forth a serious opinion if you don't know what you are saying.
You'd have to be very careful about when this would be considered assault or child endangerment. If you say that from day 1 a mother taking drugs is child endangerment, then you open the door to overturn abortion rights for women. States have laws as to when a fetus becomes classified a living person, so there would be some argument there to prosecute a mother at that point.

I work with drugs exposed babies and yes the mother should definitley be punished for what they do to these children. Most of the time the babies are taken away at birth and put in foster care and the mom has to complete a drug program if they want to see the baby again. You're wrong about the baby's ability to become "un-addicted" though. The babies go through some serious and painful withdrawls but they do quicky get it out of their system, but not before it affects their brain though.

It's not legal. She can be put in jail pregnant and all. Some doctors drug test you while you are pregnant and if the problem is bad enough, CPS will take the baby as soon as it is born. Babies can be un-addicted, but it is the same horrible process that adults go through.

Unfortunately, the law rarely looks at a fetus as a person until it is born. So until the child is born the mother is technically not endangering anyone but herself. However, if the child dies because of her drug use, I think she can be prosecuted. I'm guessing on that one. there are now new laws that allow someone to be tried for the wrongful death of a late term fetus through assault or death of the mother.

I agree. I was a long time smoker, and have quite every time I had a baby. I am pregnant now and have quite for good!!! It is a hard thing to quite, and when a woman is pregnant, she is already having alot of crap to deal with. But There is still no excuse for forcing a fetus to smoke. But instead of being rude to just pregnant woman, make it an all around deal. What about smoking in cars with kids, and smoking at a playground, and smoking outside a MC. Donald's. Its alot bigger than a problem than people think. Thanks for acknowledging there is a problem!!

I think you are right. Mothers who do serious drugs with serious effects should be have consequences. A fellow Y! Answerer enlightened me about this a few days ago ((maybe a week)). I used to think you have to know the situation--but now I think why would someone do that to their baby? What situation would be so bad that they would put their baby at risk by doing a hard core drug. I believe they should go to prison and their child should be adopted.
