I don't see why not but a special one is required for the basement it's your house so I don't see why you need a permit to do anything not unless it's an addition onto the house.Yes you could say you have a bathroom in your basement when you go to sell

The permit is probably not required for you to advertise the bathroom (you need to check your state's real estate laws). However, if you do not get a permit then the real property records in your town will show that to a buyer. The buyer may want you to drop the price of your house because there is no way to make sure the bath meets building code standards.
The main reason to get the permit is because getting the permit means that the bath will be inspected by the town building inspector. Yes, that can get annoying, but think of them like the safety police. They will make sure all connections are properly made and nothing is liable to blow up on you OR leak on you.
There is a great advantage to putting in a bathroom (we did in our old home and will probably do so in our new home). You can get a higher selling price and if you will also be finishing the basement it is much better to not have to go upstairs to use a bathroom.

You may have to work at night. You'll have to dig outside down to the sewer line, unless you can tap into your drain line from the house.
If you are successful, without a permit, you'll have no problem advertising an extra bath if selling. Inspectors have no time or will to keep track of those things, only if they discover it progress.
Worst case scenario.
If they discover it in progress, you will be required to have a licensed plumber pull a permit. If you have a plumber friend, they can do that, even if "you" finish the work to specifications with the plumber's approval, as he would be responsible to the inspectors final approval.
Just be sure it is done properly. Sewer gases can be extremely unhealthy.
You don't have to advertise the location of a bath, only 2, 2 1/2, or 3, etc.

ingy's answer is dingy. (as in ding-dong) As long as you do the job according to existing codes you should have no problems. It's your house so why should you have to pay the fees. With competent help you should have at it. When you sell simply don't list the added bathroom. It will seem like an added bonus to prospective buyers. If you want to add just a commode to your basement there's an option that you might want to consider. It's called a macerating toilet. No concrete busting is required. A water line (for filling) is fitted to it and a small (3/4") line is fitted from the commode to the existing waste line. Flushed deposits are chewed up by an electric grinder and pumped up to the drain line. When unneeded the whole apparatus can be made to disappear. Good luck.

Definitely get a permit. When you are dealing with plumbing and electrical, there is much potential for big problems if it's not done up to code. Contractors are known to cut corners and if they say you don't need one, I wouldn't use that person.
Recently had a bathroom put in downstairs, with all the permits, and it looks great. I have peace of mind that it was inspected and there won't be any leaks or electrical shorts down the road.
You could run into problems when selling if you didn't get one.

The code laws apply to evacuating sewage, as much as they are designed for revenue.
The greatest disadvantage might be that you'd have to install a toilet that flushes UP, and other drains.
Selling the house issue with a basement bathroom, isn't going to be recorded by any code agency, and may increase the value,,, ONLY if the facilities are in proper working order, and properly installed.

You can do anything, as far as advrtising, no one will really know the big problem is when it comes to getting an apraisal. The apraiser will only see what is listed in the county record. So your property will be undervalued. Actually having a permit will protect you from alot of potential problems down the road. Mainly life safety issues. Sewer gas, and disease from a backed up sewer can be dangerous. Hope you got some Bob Villa skills.

All I can remember is, when my ex's family remodeled their basement and added a bathroom, they had to get a special pump to get the water from the toilet to flow UP the pipes rather than down them. I remember that because it made a lot of sense but I had never thought of that before, haha. Obviously I'm not very knowledgable when it comes to construction. You could probably visit your local library and see if they have any books about remodeling basements or bathrooms.

additions can go years without being noticed by the govt. yes you can sell it. however permits are generally cheaper than fines. the advantages are almost obvious. you can use it!!!
