For instance, the child failed in Science bec of her teacher who happened to embarass her in class in several occasions and the teacher had only 3 students who passed in the final exam out of 35 students. The child from the start was put in to shame by the adviser and teacher. Never the child received any failing marks in all subjects since grade one and only this time in her first year that she experienced such.

If the teacher unknowingly humiliated the child I do not think that you can hold her responsible. It may be a good idea to let her know what she did and how it affected your child so that the teacher is more careful with other kids in the future.
I am sorry that your child failed. If you ever find yourself in a situation like this in the future I strongly recommend that you hold a meeting with the guidance counselor. If it is something that cannot be settled then you can insist that she be changed to a different teacher.
Most often the counselor will tell you that she cannot switch your daughter to another class just because she likes one teacher more than another. If this were possible the counselors would do nothing but switch kids all the time. HOWEVER, if there is a real concern I would insist upon switching. If the counselor can't help (and it sounds like there was a problem with the adviser, too) then speak with the principal. If that gets you no where then you can go to the board office.
Good luck with this. I hope that your daughter does better when she takes the class a 2nd time.

First of all... you phrase this as 'child failed science bec (sic) of her teacher'.... hmmmm. Does your child take no responsibility for her failure?
2ndly: I would be interested to know how you came upon the information that only 3 students passed the exam. hmmmm again.
Because generally a teacher would give a retest, or give individuals a retest, or curve the grades. A teacher can have problems with administration with a ratio like that.
Lastly, your child feeling shamed by the adviser and teacher may be a personality flaw that will cause problems for adulthood and so forth.
Maybe do some science tutoring and some counseling to see what's causing this child to feel so inferior that they can't succeed in a school setting?

There is always room for improvement in our public school system, but I don't believe it is the teacher's fault if a student did not do well in his/her particular class. It is ultimately the student's responsibility to learn what is expected to pass the class. Were progress reports sent home? If so, then it would have been obvious that the student was having a hard time in class and that help was needed. If the student is young then the parents or guardians should have gotten the help the student needed as in getting a tutor or having a parent/teacher conference to discuss the problem. Yes, the teacher may not have been the best for the subject matter, but this will not be the first nor the last time a student may encounter a 'bad' teacher. Just as in life, only you can be responsible for your success or failure in whatever you do.

if parent yes

if teacher no

according to the parent its the teachers fault for the failure for discouraging her.

according to the teacher the child should have been taught to be more tough by the parent

there is no point to the blame game. ideally the child should have been more independent and resilient as in the real world if one is going to fail because of criticism then one will be a failure. And ideally it is the teachers responsibility to motivate not to discourage. it is usually better to have no teacher than a negative one.

sounds like a conference is needed to clear whats between them if that dont work go to the princepal stand up and be a voice for you child
