That's what underinsured (and uninsured) motorist cover and medical cover are for. To pay you when the other guy doesn't have enough or the right kind of insurance.

If the guy is underinsured he may lose his house to you and go bankrupt.

this is what insurance is for . your kinfolk are very lucky to be alive.if it was the other persons fault their liability insurance should cover your family's losses [ie medical bills property loss etc.] almost always these things wind up in court and the victims wind up with a settlement of some astronomical value but by the time any payments are made lawyer fees, hospital bills, and bills in general have become equally huge. with no one actually winning anything but the lawyers. all of this tears at the very fabric of family life . so be strong, do whatever has to be done to help your family heal [ if you are in school you may find a part time job but don't let your grades slip] i hope that your dads boss will hold his job for him and not let your fathers family health plan lapse [yes there are chicken crap policies out there that if you weren't hurt on the job you still need to pony up 150 or so dollars a week to keep your family covered while you recover] . this happened to me . i was lucky my boss paid that bill and then deducted it out of my pay slowly so i didn't feel it. he has insurance with a better company now. good luck and while times may seem dark right now try to laugh some, keep your spirits up, and know that with things will get better and brighter each day

Unless your part of the world has vastly different laws, which is unlikely, you should still be able to claim.

Reading this page http://info.insure.com/auto/minimum.html it seems your wording has the same meaning as here.

"Liability" insurance sounds like what the British call "Third party only". Unless the world has a completely different meaning there, that means they are not protecting against damage done to their own car, they're just insuring against what damage they might do to other people, cars or property. Their "liability" to you because of their bad driving is what is covered.

You should contact your own insurance company or legal representatives for advice. Make sure you keep all invoices and receipts for medical expenses, transport expenses incurred as a result of the wreck, loss of earnings as a result of not being able to work etc.

In the UK, if you're out of work for a month because of a wreck, you can sometimes claim from the other insurance company all other costs you've incurred. That may be different there.

Hope that helps,
froggie

liability insurance means that his insurance will pay for his screw ups that he does to innocent people. they will not pay him for damages to his own vehicle. you should be fine. let your insurance company deal with them. i had an accident sevaral years ago that wasn't my fault and the other insurance company wasn't wanting to pay. my insurance company stepped in and got them to pay quickly. good luck and hope your family gets well quickly. also, with your family's injurys being so severe, you might want to considering suing them for pain and suffering, loss time from work, etc.
