An attorney is supposed to make sure a person gets a fair trial, but quite honestly, there is no such thing as fair in the court system. It's a game very similar to chess with the DAs and attorneys and judges all trying to out manuever the others.

The person's attorney. That's why you should not try to represent yourself in court. The only person who is going to check every nuance and be sure you got a fair trial is your attorney. If he does not do it, then you can appeal to the Court of Appeal under a complaint of inadequate legal representation. You can also call him to task by contacting the local Bar Association for things which are not ethical, even if they do not constitute reversible error. That is, even if an Court of Appeal judge rules that you cannot get a new trial based on the errors, they may still be errors.

The legal system in the US is enormously complex, and to face it without a lawyer is just foolish. In the criminal courts, you must have one appointed to you if you cannot afford to hire one. In the civil courts, you can make arrangements to share the award with your attorney for a plaintiff's case (where you are the one complaining). This is called a "contingency fee" and is typically one-third of the award. Your insurance must hire a lawyer for you in cases of liability defense.

Which also means it is foolish not to have liability insurance. Hiring a liability defense attorney when you do not have insurance is very, very expensive. $200 an hour is not unusual; even more in some big cities. And you must usually pay a retainer fee up front. This is typically an amount which the attorney estimates is what it will ultimately cost, although you will be refunded the balance if it settles quickly.

The state bar association oversees the rulings, reviews, and reports made by the judge, attorneys, and clients in the event of a report of unprofessional legal conduct by any employee of the legal system.

Court cases can be appealed an the case is oversaw by that court. No new evidence can be entered into an appeals case. If the judge or attorneys are found to not follow due process or a fault is found, a negative report is made on the person in check to the state bar association. You should be able to access these records as they are usually public record. If you had a judge or attorney who has negative remarks on their record, and it could be used to change the outcome of the case, then use it to your advantage.

Defense attorney can use court records in Courts of Appeal and all the way up to the Supreme Court. Also, public support; that's why it is important that no trials be held in secretive fashion but in open courts to enable news reporters to report to the public! And, there's always the American Civil Liberties Union!

The superior court of the judges watches the judges of the lower court. Likewise, people are watching the judge and his actions. Thus, it is public opinion through media that usually checks the acts of the judge.

And if it is a case that has no jury? The person's defense lawyer, could make a plea for the judge to step down if they feel it is warranted.

thats a good question...over 1 hundred million was paid out last year to people who were wrongfully convicted.that does not include court cost, attorney, etc, etc, so yah i would like to know to?......but equal justice for all ..............i think.lol
