If so, is anything that is done after that date as far as racking up credit, the responsibility of both parties or just the one who's racked it up? Also, keeping in mind that the credit card is only in the name of the person who blew the money.

I live in California and filed for divorce and I had an attorney write up a "Marriage Settlement Agreement" which basically lays out EVERYTHING. It states the Date of Separation, which is the date you tell them you separated and then you each are responsible for your own debts from that date forward. All prior debt will be considered "joint" debt. So I had to list everything we owed and who was going to pay what. But ours was an uncontested divorce, meaning my ex agreed to the Settlement Agreement so we didn't go before the judge. I think it would be the same though, at least in California.Once my ex signed the agreement then the papers were filed at the court but everything goes by the date you separated. Hope this helps! Ok from what i heard a lawyer say untill you are divorced it is still acting like you are still married there is no such thing as "legaly seprated". So i think it will really end up as to what state you are in but thats what i was told.

till you are divorced from your spouce you are still legaley married no such think as a legal seperation by law . my opion?
