A tortoise is a land turtle. Tortoises usually have high, rounded shells as opposed to aquatic or sea turtles whose more flattened shells allow for better streamlining when swimming in water. A tortoise's feet are flattened as an adaptation to living on land. A turtle that spends more time in water has paddle-like or flipper-like feet.

Tortoises are land creatures. They don't have to be near water. Turtles are water based, and can not survive if they aren't near water.
