my daughter fell after stepping in a small hole and hurt her ankle.someone told her it was ok, but it wasnt ,we took her to the hospital because it swole up over night . can the school be sued for not notifying either parent and not making a report

I can understand being upset, but suing? You've got to be kidding.

Parents can be very protective of their kids. I have a feeling that 12 strangers won't feel as strongly about it as you do. Is it worth the legal cost for a sprained ankle? The school and teacher will have liability insurance, so the only one who is going to pay is you. And no jury is going to award damages for a hurt ankle. Kids get hurt at school. It happens. I know I wouldn't find in your favor if I was on a jury.

Contact the teacher and school nurse. You can call the principal, and if you think that your concerns haven't been taken seriously, go to the Superintendent.

You could, but the likelihood of winning is remote. Most people will not award large damages for an "accident".

Before you proceed though, ask yourself this question: "Am I ready to be sued by the school or state when my daughter gets hurt in her own home?" Because frivilous lawsuits and higher reported rates of abuse are what you are striving for when you try to use your kid's pain to hit the lottery.

Could you sue? Sure.

Should you sue? No.

Would you win? Absolutely not.

There was no loss involved. A swollen ankle is not life or limb threatening and there was no intent to harm. There is also no negligence.

Please.... try not to be one of the millions of court cases crippling out legal system.

Yes, but will it solve anything? Will you only try to get help with medical bills? Or try to bankrupt the school district? Just some thoughts

What was the injury, was it broke, or merley sprained badly ?

If they truly beleived it was ok, and did not need futher treatment I don't see what the problem is unless the injury was serious. Also how old was the child.

No. There was no loss associated with the failure. Find out whose hole it was and make a liability claim against that person.

yes, but schools are so strapped for cash these days u woud be stealing from your daughters education, so i would have them pay for medical bills only if it happened on school grounds
