If someone continuosly smokes in your presence (a mother for example in the house and car). Wouldn't this be called abuse? Can I get a court order against this person if not money? P.s. I'm in chicago, Illinois.

You can sue anyone for anything, the question is would you win??? Not unless you can prove damages. Physical damage as a result of their action. By the time the kid has lung damage evident he'll be 35.

If you are asking about a protective order for a child, you can go to court and ask, judge might grant it. Go to child protective services and explain what's going on, see what they give you for a starting point.

You can sue for just about anything. Have you expressed your grievance with the person first. In a lot of cases, if the judge knows that you didn't try to negotiate the problem first before suing, they'll throw it out.

Technically, if the smoke touches you without your consent then it may be considered battery. I don't know your state's laws. Are you a minor. A clever lawyer could argue anything.
