It is sickening to see how the American puppetdent, the supposedly leader of the free world, is inventing laws to try people outside the U.S. justice system using standards that are deplorable even for some African banana republic.
We are supposed to be the cradle of democracy and freedom. We call ourselves the "land of the free". Doesn't that mean anything anymore? Why don't we change that phrase to: "The land of the ones we declare free", and of course that declaration would be at the pleasure of the GOP.
The world is laughing about us and our twisting of international standards. I wouldn't be surprised if we would be called a rouge nation soon.

I disagree with the US policy and practice toward the terrorist suspects they have imprisoned. But you cannot in any way compare or state that the actions of the US is in anyway the same as Nazi Germany. To do this is to move the topic of the treatment of prisoners to a level of rhetoric that will defy anyone to make a sane reasoned judgement of either situation. The slapping of a prisoner or, heaven forfend, the humiliation of the prisoner by desecrating a book is not on the same level as hanging them by their wrists from meat hooks and beating the soles of their feet. Binding a prisoners hands behind his arms a little to tight immediately after capture is not the same as shooting him and his comrades, often simply because it is not convienient to deal with them. This is a bit callous, but if a prisoner is interviwed a day after being tortured, and he is articulate and has full freedom of movement I know that he wasn't tortured, he was abused. Ask John Mcain how he felt two days after torture. The actions of the military have been humiliating, sophomorphic and abuse. They were not tortured. The Nazi's started with a beating and escalated the pain from there. The Goddess help you if you ever think that that type of conduct is permissable. That is another point. The actions of the military and police in Germany and their conquered lands was legal or allowed. The US government is trying persons who they find performing violations of the law. Not very well and halfheartedly but they are taking action. As for the military tribunals there are important people, be one of them, decrying them and their idea of executeing accussed based on evidence that the condemned can never see but , I suppose, will no doubt be assured prove that they are guilty. What a comfort to the hanged that shrub is convinced they are guilty.

When was the last time that they pulled fingernails off those guys or tried to drown them like the Gestapo did? Are they feeding them some watery gruel once a day and then working them for 18 hours a day as slave labor? Have you ever even seen a move like "Schindler's List" or read a book like "Night" by Elie Wiesel? Those prisoners down in Gitmo have it better than most us and yet they throw feces at the prisoners. Once you find out what you're talking about, let us know!

The really big issue, illustrated by this and other problems like the wiretapping program the the secret gulags, oops I mean prisons in Europe, is the whole idea both that the president is above the law and that the law does not apply to our worst enemies, I have a real problem with the whole idea that we are no longer a nation of laws.

I think the people at Gitmo should be considered prisoners of war, which puts a whole different slant on their detention.
I guess we could give them all a trial similar to what the Nazis did and then execute them all.

I am not fully in agreement with how you worded your question.
If you ever knew how German Judge Roland Friesler presided in his court as a judge in the Third Reich, you may want to re think your question. Check out the footage of the trials of the Hitler Assisination Conspirators of 1944. But yes under US Law, persons accused are entitled to a fair trial:
From The Constitution
Amendment V
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty or property, without due process of law; nor shall private property be taken for public use without just compensation. - This applies to ALL PERSONS. Not just American citizens.
And more importantly:

They are detainees.... not POWs, not criminals...
They are not entitled to a trial.
Why do you flaming liberals think that the American Justice system is the end all answer to every situation.
It doesn't apply in this case.
The 6th amendment does not apply because they have not been charged with a crime under the any penal system.
They are being detained.... as is any country's right to do while engaged in a conflict. They will be repatriated in due time.
