The legality or constitutionality of any law can be determined by interpreting the original clauses in the National or State Constitution. If the law in question is a State law that originated from the National Constitution/Law (seeing all State laws must be subject to National laws), then whatsoever is in controversy will have to be determined on the Federal or National level. But if the controversy is simply a wrongful application of state law, then you'll have to (if you're in Texas) file a Declaratory Judgment suit with Travis County (because Texas law says so), not your resident county.

A judge interrpets the law and the constitution, and determines how the would apply to any particular case or controversy.

That is why checks and balances exist in the US Government to prevent a judicial official from exercising inappropriate power.
