See the amendments. IE. the tenth --"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." This means in part that congress must have been given the authority or power to take an action and it must be granted by the Constitution. All other powers are reserved for the state governments and if not them than they belong to the people.

At this time there is nothing prohibited in the Constitution. What the it does is it gives us our rights, hence the Bill of Rights. The 18th Amendment ( Prohibition) was the only to specifically take away a right. The 21st Amendment repealed the 18th.
