I saw a case like this on Judge Judy the other day, so yeah, you can sue.

I would be checking with the insurance company first, and see what they recommend(your insurance company.) Secondly you may want to make an appointment with a lawyer for at least a consultation, to see what your legal rights are in your area. Why would you ever loan anyone a vehicle to use? This is a bad policy, when it comes to friends and/or family members. Unless you can afford to be giving the item to the person, neither a borrower not a lender be. What type of friends are these people? Why are you and your family responsible for giving them rides, let them use the jeep that they were going to let you use. Your husbands dad should not even be involved in this, unless he is going to help you and your husband get another vehicle. It is one thing to want to help our friends, but to be used as a doormat is another story entirely. You can sue, I am sure; but this could be a lengthy process and you probably need a vehicle before that would be settled. I hate to tell you this, but with "friends" like this, you do not need enemies. You can say goodbye to the friendship also. I doubt if you want to keep friends like this, I would not. Talk to your insurance company and a lawyer, and then proceed from there. Good luck and have a good day.

Look at it this way. If He wrecked his own car- he would be without his jeep. Right? Unless it is an emergency ignore the calls to take them places. Don't agree to any "I will pay you later" kind of deal. He is trying to get his Jeep back. So Sorry he has to suffer but u shouldn't be out of a vehicle -He should!
Wait until the last minute because suing destroys a friendship but if you have to try Small claims court...You won't need an attorney so it will cost you less.

If your insurance is primary shouldn't you have gotten paid already? I think maybe you guys are asking a little too much. Accidents happen and he is trying to help you guys but he too can't bear the financial burden. Is the jeep their only vehicle? If so how can you reasonably expect them not to ask you for rides? So your "friend" borrowed your car and has first lent you his only vehicle and now wants to be able to make payments and you don't want to let him? Glad your not my friend

You can sue your "friend".
However you were both being irresponsible.
You should not have loaned your car out.
Cars are like underwear, something not to be loaned.
If you wouldn't wear their underwear, don't loan them your car.
I say ask for half the cost up front and count is as a lesson learned.

You can take them to small claims court. I would not expect them to be your friends after that.
