To be perfectly honest, I think it should be legal, but it never will be.

Why?

One simple fact - the government cannot regulate or tax it, so they are not going to make it legal if they can't profit from it. Why can't they regulate or tax it? Because everyone can grow it. It is not something that is manufactured - it is a plant. You don't need to process it, like tobacco for cigarettes. There is no "middle ground" needed for the use of marijuana - anyone with seeds can grow it, dry it, and smoke it (or put it in their brownies - to each their own). No one will make any money at it because you can go to anyone and get it. It will cause the price to bottom out, because the "legit" sellers will charge a regulated price, and the illegal dealers (there are illegal dealers?!?!?!) will sell it at a lower price to get the business, and they won't have to pay the "sales taxes" on it to the government, so they will make plenty of money on it.

So the long and the short of it: If the government can't control the distribution, regulate the sales and the product, and tax the hell out of it to make some money off of the sale of it, then they will not pass a law to make it legal. End of story.

I think the war on drugs is a losing battle and needs a new strategy besides throwing money at it. The benefits from the legalization of marijuana is the prison population will decrease. More then half of the people in jail are on nonviolent drug charges. Also there has been no documented case of an overdose on marijuana. I would also like to bring up the point that marijuana was originally banned because the western states wanted a reason to get rid of the Mexicans (History Channel TV show Hooked).

If the legalization of Marijuana would take place it would start off by being a very small business enterprise. Look at how its being sold now, I don't know for a fact, but I don't think its a large corporation. Also just by the plain nature of the market forces some areas that are very moral, won't use illegal drugs, would probably not have marijuana being sold there. There wouldn't be enough profit there for someone to sell marijuana.

The jury may be still out on marijuana for medical purposesm, but if you are in great pain and the only thing that helps you is smoking marijuana that person should be allowed to smoke marijuana.

My opinion is that if large businesses or government thought there was a profit, it would already be legal.
