It depends on the laws in question. If it's also a copyright violation, then that's a federal offence, and time to pack the toothbrush.

Plagiarism is NOT a criminal offense, and neither is trademark or copyright infringement. They are covered in CIVIL law, not criminal law. If you are sued, and you lose the suit, you will likely be forced to pay monetary damages.

You don't go to jail for plagarism. It falls under civil torts, not criminal.
