The 20 year old can go to jail if the parent's want to press charges. Then the 20 year old will have to registar as a sex offender if convicted. The 13 year old has no idea what they've done. This could ruin a person's life. Did the 13 year old tell the 20 year old their age? People should ask to see an state ID when dealing with young women/men, and they should use/provide protection against STDs and pregnancy.

In some states, sex with anyone 14 or younger is prosecuted as child molesting even if the 13 year old is willing. If you think about it, why would a 20 year old want to have sex with a 13 year old? He's a child molester and you should stay away from him.
In many states, if you know of an adult having sex with a child (or any other form of child abuse), you are legally required to report it to the police.
In other states, it falls under the law as "statutory rape". Statutory means that one partner was legally too young to consent to sex. Just like you can't sign a contract if you are under 18, you can't legally consent to sex at age 13. The adult partner (the 20 year old) is supposed to be old enough to know this and refrain from any sexual activity with someone not legally old enough to consent. He is legally liable for his actions.
If this is happening, I hope the police get him. I hope the other inmates in the prison take care of him (and that ain't a good thing).

if someone reports him, yes. most states have a legal consent age of 14 and up. They have lowered it because way too many guys were being put in jail for being 19 and having sex with a 16 year old. however, in some states, it's 16, 17, or 18. in my opinion, a 13 year old shouldn't be having sex. ask your friend. what if you get pregnant? abortion shouldn't be an option. ask her what if you get an std. i'm 20 years old and three of my friends have hiv. 4 have herpes. 6 have genital warts (hpv). 2 had chlymidia. it's really not a joke. it's a lot more common than you think.

Yes, by law a 13 year old child is under the control of the parents and therefore in the justice system she is not able to have her "own" decision.. If her parents were to find out, they can press charges and they will look for the man or the guy and the first thing that they will do is provide an Order of Protection not allowing him to be near her and if he violates said Order of Protection he then faces even more charges...

It depends on the country. In some countries the age of consent can be as low as twelve, meaning no, he won't go to jail.
But since this is in the U.S. section, I'm going to assume whoever lives in the U.S. And the answer is a big resounding YES. If there are charges pressed, the twenty year old can and probably will go to jail.

Yes, he could. I had just turned 18 and my girlfriend was 2 months from turning 16 (the age of consent in Mn at the time).
We had been honest with her parents and social worker about our relationship, including the truth about us having sex when they asked about it. As soon as I turned 18, after almost 3 years of dating, they pressed statutory rape charges against me. She refused to testify, so the case was thrown out. But it kept us apart for a couple of years. I ended up marrying her, and we stayed together for almost 8 more very happy years. We are still good friends although we never really talk anymore because we live so far apart and we've both remarried.

Any man who has sex with a young girl under 16 years of age is considered a child molester. Yes he can go to jail, and should go to jail for taking away her youth and what is very personal no matter if they both agreed she is to young to agree to sex at 13!!!! Where are the parents and their supervision of this child!!!!!!!!!!

There's no such thing as willing when the child is 13.
If you were my daughter - I'd make sure that he spends a LONG time in jail.
However, my daughters wouldn't ever dream of having a boyfriend, let alone one who's a sick pervert!

He could!! It is against the law. He is an adult and at 13 you are a minor. There is no reason for an adult to be having sex with even a willing minor. At thirteen you are not old enough to be making a decision that could ruin another persons life.
