I worked manipulated shifts & positions to try & make me QUIT! After 1st Unemp. Hearing told L&IRC APPEAL Mgr. "LIED UNDER OATH". That got me DISCHARGED cause he did not like being called a lier! Yet month later they requested hearing to prevent me from unemployment$$$ AGAIN, had a witness LIE, Mgr. lied again. They won again! Now i have evedence to prove they lied but inadmissable in Circuit Court of Appeals because it was not in Hearing - which I did not know what eveidence needed.

Since I have evidence after the fact to prove PERJURY, told to drop Appeal and sue directly with charges of Defamation of Character, Slander & Libel, Asked for letter of discharge which has the lies rather then the fact "Manager did not like being called a LIAR"...

Any ideas or alternative suggestions???

Defamation of character? THEY TOLD THE TRUTH!!!! How can you defame someone if you are saying something factual about them? Second, it is perfectly legal for a former employer to reveal to a prospective or new employer that an ex-employee failed a drug test. That is one of the three legal questions that a former employer may answer by law. Now, it is certainly questionable business ethics to call the new employer of an ex-employee to disclose this information, but not illegal in any way. And second, if your husband's current employer is the one who called them (which is almost certainly what happened, unless they had some sort of vendetta against your husband) then his former employer was required by law to answer truthfully, which they did. Look, I don't think your husband should be crucified because he smoked a joint, but he rolled the dice in a very dangerous game and lost. And unfortunately, it's the kind of loss that can keep on giving for the rest of his life if he chooses to stay in this profession. One thing that transportation companies do not tolerate, in this world of excessive and expensive lawsuits, is substance abuse. It's a hard fact to learn. Hopefully, all will turn out all right.
