I have been offered a job, and have to have a criminal background check. I have never been convicted of anything but I have recently been charged and I am fighting these charges. Will this show up seeing as im not convicted, and if so can my potential employer refuse to hire me based on something I'm charged with but not yet convicted of? Worried...

if you try to hide the fact that charges are pending then yes indeed the employer would probably pass you over...if you are honest to him/her then there is absolutely no reason why they would not hire you unless of course it has something to do with the job...for instance if you were a suspected pedophile then you would not be hired by a company that deals with children...at least i would hope to hell they would not hire you in that instance...if you were charged with dui and need a licence to perform the duties of the job, then you would also be out of luck...but, if you were charged with say assaulting your boyfriends mistress, then you would probably still get the job...just be honest with your perspective employer as they may appreciate that and that alone may get you the position you were applying for...GOOD LUCK!

Since I am in the burglar alarm industry we not only fingerprint and back ground check, we also do a name search at the local courthouses to determine any pending case which may have slipped though the cracks. Your employer can fire you for anything during your probationary period and if you are an at-will employee (non-union, no time commitment contract) you can be fired for anything, anytime. It may be your employer is not worried about the kind of charges you have. Its better to figure it out now.
