i think so....i think that is why they are called bootleg.... Because they were illegaly obtained to begin with...

Illegal to buy or sell, and illegal to record without permission from the band but NOT illegal to own or listen to. Here is a[n incomplete] list of bands that freely allow recording of their shows, but you still can't sell their recordings:

anything you haven't paid a copyright fee for yourself that is sold by you w/o proper taxation is considered "illegal" by the letter of the law.
