We have and 8 yr old daughter and I am leaving so he can get help with some problems he has. I have no problem with sending my child to him as he is a good father.She is in no danger etc,etc. The only thing I would worry about is that we both want her. I am willing to let him have visitations. I have nothing court ordered because I am seeing if we can work it out ourselves, however in the meantime what should I do? Thanks

Unfortunatly...you can LET him see her. You dont decide that. Unless you have temporary custody its not up to you. IF he goes down first and files, then he gets to LET you have visitation. Just cause you are the mom, doesnt give you custody. And believe me NOT ALL moms get custody even after that. I have 2 step kids that my HUSBAND has custody of. Their mother gets only 2 days a week after work to see them and everyother weekend.
So as easy as you may want to keep things, YOU need to decide how you want your life to be. If your husband understands THE LAW, then he may just beat you to the punch. And per the law, the first one who files, get temporary custody. THEN the other parent has to FIGHT and PROVE that the other is unfit in order to take custody away.
Many things are decided with custody. Whoever has primary custody makes the decisions for school, ect. THey get the final say, cause the child stays with them.
Believe me, with the experience of my husbands ex and my ex...(i have 2 kids of which I also have custody of)...I know what I am talking about.

Make out a schedule for him to adhere to or that you have both agreed upon together. Just make sure its a schedule a child can handle. The 50/50 thing is verrrry stressful on a child of that age. Its best if the child sleeps and wakes in the same home on school nights. It may not seem 'fair' to one of the parents, but the courts and time and time again it proves it's better for the child! Keep a record in case you do decide to make it permanent. I hope your estranged hubby gets the help he needs and you work things out. Good luck.

As I can see you are both custodians of your daughter as married couple are until you legally separate or divorce. And both of you have joint physical custody, and joint legal custody. He has same right what you and i suggest that you both reach amicable agreement or other wise judge will set your separation agreement. He may award you physical custody, which is also known as physical care, actual lodging and care of the child and visitation rights. And he may order joint legal custody, both parents share the ability to have access to educational, health, and other records, and have equal decision-making status where the welfare of the child is concerned. It is important to note that joint physical custody and joint legal custody are different aspects of custody, and determination is often made separately in many states' divorce courts. But best for child is a friendly custody sharing agreement between parents.

you have to be adults about it and you two come up with and agenda that will work for both of you and also be willing to compromise if it should come up that both of you want your daughter at the same time.

Well since you asked "what should I do".........I think you should grow up and stay with your husband.....what about "for better or for worse" and all that?

I GAVE MY EX UNLIMITED VISITATION WITH HIS CHILDREN. WORK IT OUT BETWEEN THE 3 OF YOU...............
