if a person can be charged with murder of an unborn fetus, if a mother can be charged with child endangerment while pregnant, then yes....that fetus has rights and tampering with sex is unethical.

It depends on the state/country, and the stage of development.
Some religions believe live begins at conceptions. Some religions believe life begins when the baby takes its first breath. Some have a more esoteric determination of life when the soul enters, at various points along the process depending upon the religion.
Since the law does not usually chose which religious definition is the correct one, the legal line is drawn based on medical determinations. And the medical determination most normally used is the point of viability, when the unborn can survive on its own independent of the mother. That is the point where legal rights generally attach.

It's still a living, breathing human being with feelings, and should be treated as such.
If the gender is that big of an issue, try adoption; since there's many couples out there unable to conceive and looking to adopt.

Well it depends on what the mother believes. if within her religion it's ok then she may follow through. It also depends on the state, country, and the trimester that the fetous is in.

i think they are human because it is union of sperm and egg=zygote=life...life=human and every human has a right. also the fetus is very fragile because it cannot defend himself so the law must protect them (also society, state, government etc)
