When the US Constitution was written, it was possible to be arrested in relation to a civil matter. So, without such a prohibition, it would be possible to summarily remove a member from Congress and deny him the right to vote and speak whilst Congress is in session. That, of course, is a recipe for political chaos, hence the protection afforded by the Constitution.

A number of scholars have observed that the provision was never intended to protect anyone in Rep. Jefferson's recent situation, ie, where criminal activity is being investigated.

It used to happen that the libs would have an opponent arrested , on trumped up charges, so they couldn't vote against giving the US away. Truth. Read history.
