Please use spell check, because although the question is perhaps understandable, it really leaves something to be desired in regards to credibility. They are not democrates nor would they file lawsuites. So having said that my answer is yes, I guess. Would the Democrats file a lawsuit if they won an election? To what purpose?

If they win, there are no damages and the case would be tossed out of court, unless it was files by the losing party. So yes, we will only file the lawsuit if we lose because that is the way the law works ;).

Only the injured party can file a lawsuit. If they win, they cannot be an injured party and cannot sue.
