Indicting someone without him having access to the evidence against him is nothing but lynch justice. "Military commissions" and the laws enabling them is nothing but a vehicle for pseudo-legality. It has nothing to do with what this country stands for and has nothing to do with humane treatment.
If they have nothing to hide, then why not try them in the open. I think that is the same argument the cons use to justify the wiretapping of America by the Bush junta.
Our (formerly known as great) nation is at the brink of fascism and we will continue to slide down the evolutionary slope until the Bush junta is stopped.

Terrorists commit acts of war...not crimes. There's a big difference and they're handled by a completely different set of law and rules.
Within the United States' criminal justice system, even Adolf Hitler would have been found not guilty of murder because he never actually "pulled the trigger."
The United States Constitution was written primarily for peaceable civilians upon US real estate. It is not designed to adjudicate foreign nationals captured on the battlefield.

Because a lot of people on answers don't understand that THEY CAN BE HELD BY THE SAME RULES FOR THE SAME REASON.
So they don't care. They don't realize that their kids could be held and tortured in secret CIA prisons or by the NSA, that Fema could suspend their constitutional rights.
They don't realize that they are just fodder for the government guns once a state of emergency is implemented, or martial law is declared.

It is NOT ok...but we are asleep at the wheel people. The masses do not choose to question and investigate things. We are too busy running the rat race and watching the VMA's to care. It is truly sad and as with any empire when it falls it will fall hard. I dread the day but I fear if we don't get involved in our own country's politics on a Federal/State and City level....we are all going to get screwed.

I'm thinking because we're in a war! Trust me, Russia would not be nice if they held you for any reason. Spend a little time in a Mexican jail for a while and tell me how they treated you.

It's not okay. But as the so called 'war on terror' is largely bogus it much more convenient for the fascists who hide under a cloak of democracy to pursue their agenda.

Get real.....if you had people living next to you that you suspected as terrioist, would you go up to them and ask them? Evidence has to be collected in secret.....We are not living in a safe world any more. I would have nothing to hide, would you?
