my partner has been septarted from his ex for almost 2 years, she left him with the children, she has applied for divorce they have the nicise but she hasn't applied for the aboslute, she wont talk, now doesnt have a solicitor and he wants to buy her out, 2 help her as well as she has hit hard times - but she is being stuborn

She has to sign off either way!!
In some places after 2 years she has no rights to any part of the marital property!

usually you apply for the aboslut right after the nisi. it then takes 6 weeks, approx to come through. any decent solictior should of told you this. an absolut isn`t automatic, you must apply. then the settlement will follow

If she has not applied 4 the absolute herself, after 2 months u can apply

She has obviously changed her mind for this absolute not to have gone through.
There's poetic justice for you two ay dear?She doesn't have to talk, sound to me that she' s done you both like a kipper! I think it's called revenge "hell hath no fury like a woman scorned".There are very few women who leave their children without just cause.I would suggest you question the reason why she left your "now "partner?

Know she is the one who left but dont think its being stubborn, its called depression/stress etc you cant think straight or give answers when you are like that - you dont know what she is going through too. Depends on the circumstances in their marriage to make her leave... her husband should write to her and explain and see if that helps

You cant force a settlement unless it is in the divorce decree

Either party can apply for the absolute
If she does not want to be helped he cannot force her

I don't think you apply for the decree absolut. I think it comes automatically after the decree nisi after a certain time.
