Call the ombudsman's office (dial 3-1-1 and ask to be transferred). They can often cut through red tape and the rude and nonsensical attitude of those paper-pushers. If your mother can prove payment (cancelled cheques, bank statements, copies of receipts), she can always wait until she gets her dispossess notice (she MUST appear) and show the court, whereupon it will be put to rest. IF she missed the hearing, and she gets a 24-hour notice of eviction, she MUST get an attorney to submit a show cause to the courts to put a stop to the 24-hour eviction notice. If she waits too long, and she doesn't answer or prove her case, she can be homeless... I suggest that she also call the Mayor's Office and speak wtih someone there. CALL. Don't sit on your thumgs, please. I've seen many people get evicted on "mistakes" but evicted they stayed!

I am not an attorney. Call Legal Services or Legal Aid... call any Tenant Action group for assistance. Don't wait until the Marshal comes to the door to take her things and put them in storage at her expense (which can be auctioned off to pay for the monthly storage fee).

You or your mother should contact Legal Aid, first thing Monday morning, to see if they can assist her. Or, ask her case workers to give her the telephone number of some legal aid attorneys.

Also, tell your mom to dial 311 and ask for a referral to a Legal Aid offce. That number is: 311 NOT 411. 311 is the number for information regarding the city of New York and, probably situations like your mother has.

As long as her rent is truely taken care off, you are in the right, and can ask them to back off. A court action is not really recommended due to long delays and high costs, but can consider ADR such as Arbitration to resolve matter.

Your best bet is to call "Legal Aid"
I am serious. I can't think of any other agency that might be of some assistance...And their services are free
