I have a brother who married a mexican woman, he did not apply for a fiance`e pass? We were wondering if the marriage would be void if not done properly? and also she has a border pass? which allows her 50 miles past border and well shes way over that, does that also make her illegal, her family says no. We just want her out of here

If the proper procedures were not followed, then the marriage may not be legal. If your brother married his wife just so she could live in the US, that is illegal. If he is caught, he can be fined.

To gsschulte: When people marry foreigners, their spouses do not automatically become US citizens. They can become naturalized citizens after they satisfy several conditions like living in the USA for a number of years and passing a citizenship test, etc.

The legality of the marriage has nothing to do with her immigration status whatsoever. If they got a legal marriage license, waited the appropriate number of days, and had the marriage solemnized by someone authorized in your state to do so, they are married. She may, however, be in the country illegally.

If it says 50 miles and she is 51 then it is against the law. That is like the old saying, " give them an inch and they'll take a mile." Well they gave her 50 and she took 100.

well your brother can always anull the marriage but as for everything else i dont think you have recourse. once she marries him she becomes a citizen according to US law. but if you really want to know you need to call Immigration and Naturalization or visit a website

Well if your brother loves her you are the biggest a.ss hole in the world. and if he doesnt call immigration and get your brother in jail.
