3) Cost me over 1000 dollars when he disallowed me to travel for other companies.

I am a beer vendor. I sell beer in the seats of sports parks.
My boss says I am not allowed to travel and work for other outlets in the company even though I am allowed to work when I want to work with no harm to me as long as I call 3 hours before the event.
I did all that...My union is weak........

You meet all of the requirements to be considered an employee. That includes your employer determining where you work.

Taxes are not taken out on an independent contractor, but are required to be taken out on an employee.

If taxes come out of your check you are not an independent contractor. Makes me wonder if your boss is paying the taxes to the IRS or putting it in his pocket. I would bet it's going in his pocket. Do you get a W-4 at the end of the year? Tell your boss you will be discussing this with the IRS and see what his reaction is. If he pulls out a gun and shoots you, then you are being cheated. End of story...

There is a check-list of 12 to 15 points (depending on the version) that is used to determine which someone is.

The bottom line is that unless you get audited, whatever you file as and whatever your boss files as (if they match) is usually accepted.

That makes you an employee. I work for a staffing agency and I can work or not, sign up with other jobs and am responsible for my own taxes. I also deduct gas and uniforms.
