The FCC gets its authority from ... Communications Act of 1934! Although a part of the federal government the FCC is an independent agency. The constitution is an old document and wasn't written to cover everything. They are not "ignoring the bill of rights", they are giving you (the listener or viewer) the security to choose what you allow your children to be subjected to. And that sir is what the government is made to do. Give you security.
