Police said Hilton failed a sobriety test but she has not been charged with any offense. That decision will be made by the Los Angles County District Attorney in the next few days.

Paris Hilton was booked into an LAPD substation ( Booking # 9194804) approx 1:00 AM PDT this morning and released after posting $5,000 bail. She has been charged with one count of misdemanor DUI.

She was booked on suspicion of misdemeanor DUI and released on her own recognizance. In some cases it takes a few days to formally charge someone, because they "investigate" the situation.
