isnt the earth 23.5 degree angle relative to the ecliptic & diameter of the earth maximum at the equator?

Well (assuming you mean the ecliptic plane) our orbital radius is around 149,597,000 km and the Earth's mean radius is about 6,000 km.

149597000/6000 ~ 24,933

so it's about 1/24933th the size of the ecliptic plane

The ecliptic has a diameter 23,250 times the Earth. 8,000 miles compared to 186,000,000 miles.
